Terms of Service — Language Services

Essential summary

  • Nature of the service. Teaching German is a collaborative learning process. Results also depend on the student's commitment, practice and dedication.
  • Cancellations. Classes must be cancelled or rescheduled with a minimum of 24 hours' notice. Otherwise the class will be treated as delivered and charged in full.
  • Confidentiality. The student's personal data will be treated with the utmost confidentiality under the GDPR and Spanish LOPDGDD.

1. Purpose and scope

These terms govern the provision of German-as-a-foreign-language teaching services, preparation for official examinations (TELC, Goethe, EOI, Pflege), specialised training for healthcare workers and corporate training, between the owner of the site and the student or contracting entity.

Booking any class or course implies full acceptance of these terms and of the current Privacy Policy and Legal Notice.

3. Nature of the service

The services offered are a collaborative learning process between student and teacher. The owner brings her experience, methodology and materials; the student commits to attendance, participation and independent practice between sessions.

The success of the learning depends on the combination of teaching, personal practice and student commitment. The owner cannot guarantee the passing of official examinations or a specific level of proficiency by a given date, although she will apply all professional means at her disposal to help.

4. Target audience and minors

Services are intended for people aged 18 or older with legal capacity to contract. The owner reserves the right to assess the suitability of the service for each request.

For minors, engagement requires prior written consent from parents, guardians or legal representatives.

5. Booking process

5.1 Trial class

The owner offers the possibility of arranging an initial trial class, whose conditions and price will be communicated to the student beforehand.

5.2 Booking classes and courses

Booking is done through the contact form, email or phone, and is confirmed when the owner sends the student the date, time, format and payment instructions.

5.3 Price and payment

The price is the one in force at the time of booking and will be communicated to the student before the reservation is confirmed. Payment is made in advance, except where expressly agreed otherwise for long courses or corporate programmes.

Accepted payment methods are: bank transfer, electronic payment gateway or any other agreed method.

5.4 Class duration

Individual classes have a standard duration of 60 minutes, unless otherwise expressly agreed. Group classes, exam preparation courses and corporate programmes are governed by the specific schedule agreed.

5.5 Formats

Services are provided:

  • Online, via Zoom or Teams;
  • In person, when agreed;
  • In small groups or individually;
  • Custom corporate courses, including subsidised options.

6. Punctuality and attendance

The student agrees to attend at the agreed date and time. A delay of more than 15 minutes from the scheduled time will be treated as a cancellation by the student and no refund will apply. If the student connects within that window, the class will use the remaining time and the full fee will be charged.

7. Cancellations, rescheduling and refunds

  • Cancellations or rescheduling must be notified with a minimum of 24 hours' notice by email or phone.
  • Outside that window, the class will be treated as delivered and charged in full, except in cases of duly justified force majeure or illness, considered on a case-by-case basis.
  • For packages or courses, classes not attended for reasons attributable to the student will not be refundable, without prejudice to attempts to reschedule them within the validity of the package.
  • Refunds, where applicable, will be issued using the same payment method.

8. Right of withdrawal

Under article 103 of Royal Legislative Decree 1/2007 (TRLGDCU) and Law 34/2002 (LSSI-CE), the right of withdrawal does not apply to classes once their provision has begun, given their personal nature.

For classes or courses not yet started, the student may withdraw by observing the deadlines in section 7.

9. Official examinations

For exam preparation services (TELC, Goethe, EOI, Pflege), the owner provides the material and pedagogical guidance. The examination fees, registration and administrative procedures with the examining body are the responsibility of the student.

The owner does not guarantee passing the examination, though she will advise the student on preparation progress.

10. Technical requirements (online classes)

For online classes, the student agrees to have:

  • a stable internet connection;
  • a device with a working camera and microphone;
  • a suitable learning environment, free from interruptions;
  • basic familiarity with the agreed platform (Zoom, Teams).

Failure to meet these requirements by the student will not exempt them from paying for the class.

11. Disclaimer of liability

The owner does not offer any guarantee of learning outcomes or of passing official examinations, as these depend on the student's commitment, practice and dedication.

The owner will not be liable for:

  • occasional service interruptions due to causes beyond her control;
  • technical failures of the platform, the student's connection or third-party services;
  • administrative or academic decisions of external examining bodies.

12. Personal data protection

The processing of personal data is governed by the Privacy Policy of this section. By engaging the service, the student acknowledges having read and accepted said policy.

13. Intellectual property of teaching material

Materials, exercises, notes and teaching content produced or compiled by the owner are her intellectual property or are covered by the corresponding licences. The student may use them for their personal learning, but is not authorised to reproduce, distribute or share them with third parties without express consent.

14. Corporate courses

Corporate programmes are governed by a specific contract detailing the number of hours, schedule, format, price and particular conditions, including any conditions for the management of subsidies (for example, FUNDAE-funded training).

15. Complaints

Complaints will be dealt with first by email to dozentin.dagmar@gmail.com, with a reasonable response within one month.

If no solution is found, the student may resort to the European online dispute resolution platform at http://ec.europa.eu/odr.

16. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the student's domicile when acting as a consumer, in accordance with the TRLGDCU.
